The EU Officially Adopts the Bisphenol A (BPA) Ban on Food Contact Materials
On December 31, 2024, the Official Journal of the European Union officially issued the Bisphenol A (BPA) ban (EU) 2024/3190. This requirement further amends the plastics regulation (EU) 10/2011 and repeals (EU) 2018/2013, marking a comprehensive ban on BPA in food contact materials (FCM) by the EU and its member states. The ban will come into force on January 20, 2025. The main contents are as follows:
I. BPA Prohibition Requirements
(1) The use of BPA and its salts in the manufacture of adhesives, rubbers, ion - exchange resins, plastics, printing inks, silicones, and varnishes and coatings for food contact materials is prohibited. Also, the placing on the EU market of food contact materials and articles manufactured using BPA is prohibited.
(2) The use of bisphenols or bisphenol derivatives other than BPA for the manufacture and sale of food contact materials is prohibited, unless authorized, and no BPA residue is allowed.
(3) Specific exemptions for BPA.
II. Amendments to (EU) No 10/2011
(1) In Article 6 "Exemptions for substances not included in the EU list", the following content is added: As a partial exemption to Article 5, "bisphenol A" or "BPA" (CAS: 80 - 05 - 7) and other harmful bisphenols or harmful bisphenol derivatives as defined in the proposal can only be used for the manufacture of plastic materials and articles that meet the requirements of the proposal (i.e., the exemption requirements in Appendix II).
(2) In Table 1 of Appendix I of (EU) 10/2011, the entries for Substance No. 151 BPA and Substance No. 154 BPS (CAS: 80 - 09 - 1) are deleted.
III. Provisions on the Transition Period
(1) Single - use food contact articles can continue to be sold until July 20, 2026. For special products such as those used for preserving vegetables or fruits, aquatic products, or those with varnishes or coatings manufactured using BPA applied to the outer surface of metals, they can continue to be sold until January 20, 2028.
(2) Reusable food contact articles can be placed on the market for the first time until July 20, 2026, and the inventory can be sold out until January 20, 2029. However, for reusable food contact items used in professional food production equipment, if they comply with the rules applicable before the entry into force of this regulation but do not comply with the rules in this regulation, they can be placed on the market for the first time until January 20, 2028.
